4.2 Trademarks. Gamma and all related graphics, logos, service marks and trade names used on or in connection with any Services or in connection with the Services are the trademarks of Gamma and may not be used without permission in connection with your, or any third-party, products or services. Other trademarks, service marks and trade names that may appear on or in Services are the property of their respective owners.

4.3 Your Content. Gamma does not claim ownership of Your Content. However, when you as a Registered User post or publish Your Content on or in Services, you represent that you own and/or have sufficient rights to Your Content to grant the license set forth in Section 4.4 (License to Your Content).

4.4 License to Your Content. Subject to any applicable Account settings that you select, you grant Gamma a fully paid, royalty-free, worldwide, non-exclusive and fully sublicensable right and license to use Your Content (in whole or in part) for the purposes of operating and providing Services to you, including, without limitation, as necessary to provide product support, debug issues, and improve your product experience. You further grant any Registered User with whom you choose to Collaborate a fully paid, royalty-free, revocable, worldwide, non-exclusive right and license to use, modify, adapt, publicly perform, and publicly display Your Content in accordance with your Account settings and the functionality of the Services. Please remember that any of Your Content that you submit to any "public" area of the Services may be visible to other Registered Users or other visitors to the Site. You warrant that the holder of any worldwide intellectual property right, including moral rights, in Your Content, has completely and effectively waived all such rights and validly and irrevocably granted to you the right to grant the license stated above. You agree that you, not Gamma, are responsible for all of Your Content that you Make Available on or in Services. Any Content posted by you may not contain content that violates Gamma's Acceptable Use Policy, as determined by Gamma in its sole discretion.

4.5 AI Model Training. If you are on a Team or Business plan, we do not train on Your Content. If your plan does not include privacy controls for AI training or if you do not have such privacy controls for AI training turned on, you agree that we may, and you hereby grant us, a fully paid, royalty-free, perpetual, irrevocable, worldwide, non-exclusive and fully sublicensable right (including any moral rights) and license to use Your Content to train, improve and refine our models, machine learning systems, products and services.

4.6 Feedback. You agree that submission of any ideas, suggestions, documents, and/or proposals to Gamma, whether through the Site or any other ("Feedback") is at your own risk and that Gamma has no obligations (including without limitation obligations of confidentiality) with respect to such Feedback. You represent and warrant that you have all rights necessary to submit the Feedback. You hereby grant to Gamma a fully paid, royalty-free, perpetual, irrevocable, worldwide, non-exclusive, and fully sublicensable right and license to use, reproduce, perform, display, distribute, adapt, modify, re-format, create derivative works of, and otherwise commercially or non-commercially exploit in any manner, any and all Feedback, and to sublicense the foregoing rights, in connection with the operation and maintenance of the Services and/or Gamma's business.

4.7 Service Analytics and Improvement. You hereby grant us, a fully paid, royalty-free, perpetual, irrevocable, worldwide, non-exclusive and fully sublicensable right (including any moral rights) and license to analyze usage patterns, performance metrics, prompts, and other data derived from Your Content to improve our Services, conduct analytics, troubleshoot issues, and enhance the overall user experience. This includes created aggregated and anonymized insights, but DOES NOT include using Your Content to train AI Models unless permitted under Section 4.5.

4.8 Data Processing Addendum. To the extent the Services involve the processing of "personal data," "personal information," "personally identifiable information," (or any such similar term under applicable laws), the parties shall comply with their obligations under the Data Processing Addendum located at https://gamma.app/dpa as updated from time-to-time.
